Not all renters in NSW are tenants. Tenants have more legal rights than other renters like boarders and lodgers. Boarders and lodgers are marginal renters. The law does not offer them as much protection as it does for tenants.
A boarder usually rents a room in a boarding house or a “registrable boarding house”. Surprisingly though, a person in a boarding house can legally assert that they are tenants and claim the full protection of the law.
Knowing the rights and obligations of a boarder is key to understanding whether someone is a tenant, a boarder, or another marginal renter.
